Restriction Resolution
RESOLUTION
OF THE BOARD OF TRUSTEES
OF ROY
WATER CONSERVANCY SUBDISTRICT
WHEREAS, Utah Code Annotated, at 17A-2-1435(1), provides
that the Board of Trustees has the power to make and enforce all
reasonable rules and regulations for the management, control, delivery,
use, and distribution of water; and
WHEREAS, pursuant thereto, the Board had therefore
promulgated rules and regulations including the rule that no watering is
allowed from 10:00 a.m. to 6:00 p.m. on any day; and
WHEREAS, the Board finds it necessary and in public
interest for the conservation of water to put in place a policy
regarding enforcement of the rules.
NOW THEREFORE, BE IT RESOLVED by the Board of Trustees of
Roy Water Conservancy Subdistrict that:
In the course of any water year, the owner of the property or the agent
of the owner in violation of the rule prohibiting watering from 10:00
a.m. to 6:00 p.m. on any day shall be issued a citation for the first
and second violations. Upon a third violation of the rule, the
Subdistrict shall terminate water service to the property. Water
service shall be restored upon the payment to Subdistrict, at its
office, of the sum of FIFTY ($50.00) DOLLARS re-connection fee. A
fourth violation shall result in the Subdistrict terminating water
service to the property for the balance of the water year.
Provided, however, in such event such owner shall, nonetheless, be
billed the full water assessment.
BE IT FURTHER RESOLVED that this Resolution ought to and
shall take effect upon its adoption.

of May, 2002.
